Terms of Service — AI Services

1. Acceptance of Terms

Welcome to PodcastGen ("we" or "us"). We are a company incorporated under applicable laws.

These Terms of Service ("Terms") govern your access to and use of our AI-powered podcast generation services, including article-to-podcast conversion, script generation, and text-to-speech audio synthesis (the "Service"), available at https://podcastgen.com.

⚠️ Important: If you do not agree to these Terms, stop using the Service. Continued use after any update constitutes acceptance of the revised Terms.

2. Description of Service

PodcastGen provides an AI-powered platform that transforms articles, blog posts, URLs, and documents into natural-sounding podcasts. Our AI generates conversational scripts with two virtual hosts and produces downloadable MP3 audio files.

2.1 Service Nature

This Service is a digital intangible product. Service access is granted immediately upon payment confirmation. Due to the immediate delivery nature of digital services, refunds are subject to specific limitations outlined in Section 7.

2.2 AI Model Disclosure

This Service uses third-party AI model providers, including DeepSeek for script generation and third-party text-to-speech providers for audio synthesis. Service performance and availability may be affected by these providers' operational status. Significant disruptions will be communicated to users promptly.

3. Account Registration

3.1 Account Creation

Using this Service requires creating an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all operations under your account.

3.2 Account Security

• Report unauthorized use immediately to security@podcastgen.com
• Do not share login credentials with any third party
• Ensure your billing email address remains valid

3.3 Enterprise Accounts

If registering on behalf of a company or organization, you declare that you are authorized to enter into this agreement on behalf of that entity.

4. Subscription Plans (V1)

We offer subscription plans to access this Service. Current plan details and pricing are available at /pricing.

We reserve the right to modify plan features or introduce new plans at any time. Price changes are governed by Section 5.1.

5. Billing and Payment (V1)

5.1 Auto-Renewal Authorization

By providing a payment method and subscribing to a paid plan, you explicitly authorize PodcastGen to charge your payment method periodically for the corresponding subscription fee. This periodic authorization remains effective until you cancel per Section 6.

Your subscription auto-renews at the end of each billing cycle unless canceled. For annual subscriptions, we will send a reminder before renewal.

5.2 Taxes

Unless otherwise stated, all prices are exclusive of applicable taxes (including VAT, GST, sales tax, etc.). If required by applicable law, we will collect and remit such taxes.

6. Cancellation Policy (V1)

6.1 How to Cancel

You may cancel your subscription at any time through either:

• Online (recommended): Account Settings → Subscription → Cancel Subscription
• Email: Send a cancellation request from your registered email to cancel@podcastgen.com

Cancellation takes effect immediately. We will send a confirmation email within 10 minutes.

6.2 Effect of Cancellation

• Subscription remains active until the end of the current billing cycle
• No charges will be made in subsequent billing cycles
• Account data will be retained for 90 days after cancellation, then deleted per our Privacy Policy

7. Refund Policy (V1)

7.1 General Policy

Due to the immediate delivery and intangible nature of our digital Service, subscription fees are generally non-refundable, except in the following circumstances.

7.2 Refundable Cases

• First-time subscriber 7-day guarantee: First-time subscribers may request a full refund within 7 days of first charge, provided usage does not exceed 20% of plan quota
• Duplicate charges: Full refund for duplicate charges caused by billing errors
• Verified service interruption (over 72 hours): Proportional refund or credit for prolonged interruptions caused by us
• Legal rights: Revocation or refund rights under applicable law (e.g., EU/UK 14-day cooling-off period) are preserved

7.3 How to Request a Refund

Send refund requests to refunds@podcastgen.com with your account email, transaction ID, and reason for refund. We will confirm within 2 business days and process eligible refunds within 5–10 business days.

7.4 Non-Refundable Cases

• Used subscription period fees (except in Section 7.2 cases)
• Annual subscription refund requests made 30 days after initial purchase
• Accounts closed due to violation of these Terms or Acceptable Use Policy

8. Billing Disputes

If you believe a charge is in error, please contact us at billing@podcastgen.com before contacting your bank. We commit to responding within 2 business days and resolving confirmed billing errors within 5 business days.

9. AI Content and Intellectual Property

9.1 Output Content Ownership

Subject to these Terms, AI-generated content ("Output Content") produced from your inputs belongs to you. You may use Output Content for any lawful purpose permitted under Section 10.

9.2 Input Content License

By submitting content to this Service ("Input Content"), you grant PodcastGen a limited, non-exclusive license solely for providing the Service to you. We will not use your Input Content for AI model training without your explicit consent.

9.3 Third-Party AI Model Dependence

This Service uses third-party AI model providers, including DeepSeek and text-to-speech providers. Output Content may be influenced by these providers' models. We do not guarantee specific output quality and assume no responsibility for content generated by third-party models.

9.4 AI Output Accuracy

AI-generated content may contain errors, inaccuracies, or be outdated. You are responsible for reviewing and verifying Output Content before relying on it.

10. Acceptable Use Policy

10.1 Permitted Uses

You may only use this Service for lawful purposes consistent with these Terms, including personal productivity, business automation, research, and development activities.

10.2 Prohibited Uses

You agree NOT to use this Service to:

• Generate illegal, defamatory, harassing, or fraudulent content
• Generate, distribute, or assist in producing deepfake content, including AI-synthesized audio, video, or images impersonating real individuals or intended to mislead viewers about their source or authenticity
• Generate content involving the sexualization of minors or violating child protection laws
• Create malware, phishing content, or cyberattack tools
• Infringe any third party's intellectual property or privacy rights
• Bypass or interfere with this Service's security features
• Resell or sublicense access rights without prior written approval
• Violate any applicable law, regulation, or card network rules

10.3 AI Merchant-Specific Prohibitions

In addition to the above general prohibitions, given this Service's AI technology attributes, you explicitly agree NOT to:

• Use this Service's inputs, outputs, model responses, or any derivative data to train, fine-tune, benchmark, knowledge-distill, or otherwise develop any artificial intelligence or machine learning model that directly or indirectly competes with this Service or PodcastGen products
• Large-scale systematic scraping, extracting, or collecting model outputs for any purpose beyond your authorized personal use
• Present AI-generated content as the work of human professionals (such as licensed doctors, lawyers, or financial advisors) in contexts where this could cause harm

11. Data, Privacy, and Security

Your use of this Service is subject to our Privacy Policy, published at /privacy. Payment card data is processed exclusively by our PCI-DSS-compliant payment processor, Waffo Pancake, and is not stored on our servers. Account data is retained for 90 days after cancellation, then deleted.

12. Disclaimer and Limitation of Liability

12.1 Disclaimer

This Service is provided on an "AS IS" and "AS AVAILABLE" basis without any express or implied warranties, including merchantability, fitness for a particular purpose, or AI output accuracy.

12.2 AI Generated Content Disclaimer

⚠️ AI Generated Content Disclaimer: This Service's AI outputs may be inaccurate, incomplete, or outdated. Do not use them for legal, medical, financial, or other professional advice. Always verify with qualified professionals before acting on AI-generated content.

12.3 Limitation of Liability

To the maximum extent permitted by applicable law, PodcastGen assumes no liability for any indirect, incidental, special, consequential, or punitive damages. Our total liability is limited to the amount you paid us in the 12 months preceding the claim event.

13. Term and Termination

These Terms remain effective during your use of this Service. We may suspend or terminate your account if you materially breach these Terms, are suspected of fraudulent activity, or when required by law. If we terminate the Service for reasons not attributable to your breach, we will refund proportionally for unused prepaid portions. You may delete your account at any time by contacting support@podcastgen.com.

14. Governing Law and Dispute Resolution

These Terms are governed by applicable laws. Before initiating formal proceedings, please contact legal@podcastgen.com to attempt informal resolution.

15. General Provisions

We may update these Terms at any time. Material changes will be communicated at least 14 days in advance via email. Continued use constitutes acceptance of revised Terms. If any provision is found invalid, the remaining provisions remain fully effective. These Terms, together with the Privacy Policy, constitute the complete agreement between you and PodcastGen.
